For that recommendation no grounds were given.

found myself unable to make any submission to your Excellency
on behalf of the accused, but in view of the strong recommend-
-ation of a special jury who had all the facts and arguments
of counsel before them i do not wish anything in this report
to be taken as a suggestion that effect should not be given
to the expressed hopes of the jury.

letters referred to in paragraph 18, I attach here to copies
of my notes and of the shorthand no te of my summing up.

No notice of appeal against the verdict has
yet been given but if such is given I shall at once notify
